1. People subjected to criminal prosecution (suspect or defendant) in cases envisioned by the RA Criminal Procedure Code based on the decision or application of the body (investigator, court) performing the proceedings;
2. People recognized as incapable based on the decision of the court conducting the proceedings;

In case of applying to the Public Defender’s Office free legal aid is provided to the following 16 groups of people:

People subjected to domestic violence according to the RA law on Prevention of Domestic Violence, Protection of People Subjected to Domestic Violence and Restoration of Solidarity in the Family

Free legal aid cannot be given to the following people:
1) Cases of entrepreneurial nature (including corporate disputes);
2) On cases concerning property (monetary) claims surpassing the 1000 fold of minimum salary (one million AMD), except cases, where a person is presented as a respondent or third person presented from the side of the respondent;
3) If there is trustworthy factual data disproving the insolvency of the applying person.
A natural person is insolvent when he/she has no sufficient income, a working family member living with him/her, and has no other real property or vehicle with value surpassing the 1000 fold of minimum salary in addition to his/her house.
Free legal aid can be not given also to obviously illegal and ungrounded claim cases, where the person is the plaintiff or applicant.
